Agreement between user and Potioncast

Welcome to potioncast.com. The potioncast.com website (the "Site") is operated by Potioncast Corporation ("Potioncast," "we," or "us"). The Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of the Site constitutes your agreement to all such Terms. Please read these Terms carefully and keep a copy for your reference.

What Potioncast provides

Potioncast Corporation operates a website and a portfolio of ticketed live attractions. Our live attractions currently include:

The Site allows users to create an account, provide identity inputs used to personalize attraction visits, purchase tickets to live events, and view a private record of their own visit history. Potioncast may also offer event-related merchandise and promotional offers.

Potioncast no longer operates an SMS messaging service, digital identity card product, or subscription product. Any prior terms governing those services are superseded by this document.

Privacy

Your use of the Site is subject to Potioncast's Privacy Policy, which governs the Site and informs users of our data collection practices, including our use of AI systems and third party service providers. We never sell your information.

Electronic communications

Visiting potioncast.com or sending emails to Potioncast constitutes electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

Transactional email, including account verification codes, ticket confirmations, and event updates, is a necessary part of the service and cannot be opted out of while you maintain an account.

When you create an account, you are enrolled in our newsletter and will receive occasional email about upcoming shows and announcements. This is disclosed at the point of account creation. You may unsubscribe at any time using the link in any such message or by changing your preference in your account. Unsubscribing does not stop transactional email related to tickets you hold.

Eligibility and your account

You must be 18 years of age or older to create a Potioncast account. By creating an account, you represent and warrant that you are at least 18 years old.

You are responsible for maintaining the confidentiality of your account credentials and for restricting access to your devices, and you agree to accept responsibility for all activity that occurs under your account. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Potioncast is not responsible for third party access to your account that results from theft or misappropriation of your credentials.

Potioncast does not knowingly collect personal information from persons under the age of 18 through the Site. Guests under 18 may physically attend Potioncast attractions where permitted by venue policy and applicable law, subject to the accompaniment requirements described below, but they do not receive personalized readings, are not addressed by our AI systems, and no personal information about them is collected or stored.

Potioncast and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

Your archetype and your memory

Potioncast maintains two separate categories of user data, and they are governed by different rules.

Archetype consists of identity inputs you voluntarily provide, such as birth date, birth time, and birth location, along with values computed from those inputs. Archetype information is read by our attractions in order to personalize your experience. You may view, edit, or clear your archetype information at any time from your account.

Memory consists of the record of your visits to Potioncast attractions, including a summary of each reading or experience you received. Memory is visible only to you and is never disclosed to any other guest.

A summary of your previous visits to an attraction may be read by that same attraction on a later visit, so that a returning guest receives continuity rather than a repetition. Memory is not shared between attractions: a visit recorded at one attraction is not read by another. This use of Memory is subject to your AI personalization settings for that attraction, described below. If you disable AI personalization for an attraction, that attraction does not read your Memory.

You may view your Memory at any time from your account, and you may delete individual visit records or your entire Memory.

Information about who you attend with is recorded to your own Memory for your reference only. It is never read by our attractions, never referenced during an experience, and never disclosed to any other guest.

AI interactions, transparency, and entertainment disclaimer

Potioncast uses AI technology, provided by Anthropic, to generate personalized content including readings and summaries. By using Potioncast services, you acknowledge and agree to the following:

Entertainment-only disclaimer. All AI-generated readings, identity insights, astrological interpretations, and interactive experiences provided by Potioncast are intended solely for entertainment, storytelling, and creative engagement purposes. Potioncast services are not intended to provide professional advice, including but not limited to medical, psychological, mental health, legal, financial, or relationship advice, and should not be relied upon as such.

Crisis support disclaimer. Under applicable laws, including California Senate Bill 243 (SB 243), Potioncast expressly notifies users that AI systems are not suitable for crisis or emergency support. If you are experiencing emotional distress, mental health concerns, or a crisis situation, you should contact a licensed professional or emergency services immediately.

Live attraction attendance

Entry. Admission requires a valid ticket and the entry code associated with that ticket. Entry codes are delivered electronically following purchase. You are responsible for keeping your entry code secure. Potioncast is not responsible for admission granted to a person presenting your entry code.

Venue rules and conduct. Potioncast attractions operate at third party venues. You agree to comply with all venue rules, posted policies, and instructions from Potioncast or venue staff. Potioncast reserves the right to refuse entry to, or remove from the premises, any person who is disruptive, intoxicated, non-compliant with staff instruction, or who poses a risk to themselves, other guests, staff, or the installation. No refund is issued in these circumstances.

Assumption of risk. Potioncast attractions are physical installations that may include low lighting, darkness, confined or enclosed spaces, fog or haze effects, flashing or strobing light, amplified sound, sudden sensory effects, theatrical startle elements, and uneven or obstructed floor surfaces. By attending, you voluntarily assume all risks associated with attendance, including the risk of personal injury.

Health advisory. Potioncast attractions may not be suitable for individuals who are pregnant, who have heart conditions, epilepsy or photosensitivity, respiratory conditions, mobility limitations, claustrophobia, anxiety conditions, or other physical or psychological conditions that could be aggravated by the conditions described above. You are responsible for determining whether attendance is appropriate for you. If you have questions about accessibility or accommodation, contact us before purchasing.

Accompaniment of minors. Where minors are permitted at a given event, any guest under 18 must be accompanied at all times by a parent or legal guardian who is present at the attraction. The accompanying adult assumes full responsibility for that minor's attendance and conduct.

Motion sensing. Certain attractions, including Séance Tonight, use motion sensing to detect movement and body position in order to drive the experience in real time. This processing occurs for the sole purpose of operating the attraction during your visit.

Recording at events. Potioncast, its staff, and its contractors may photograph or record at events for documentation and promotional purposes. By attending, you consent to being photographed or recorded and to Potioncast's use of that material, without compensation, in any medium. If you do not wish to appear in such material, notify staff on arrival and we will make reasonable efforts to accommodate you. Guests may take personal photographs and video for non-commercial personal use unless otherwise posted at the venue. Commercial photography, video, or broadcast requires prior written permission from Potioncast.

Personal property. Potioncast is not responsible for lost, stolen, or damaged personal property.

Tickets

Purchase. Tickets are sold for specific events at specific dates, times, and venues. All prices are stated in U.S. dollars. Applicable taxes and fees are calculated at checkout. Payment is processed by Stripe, and your purchase is additionally subject to Stripe's terms.

Tickets are fixed after purchase. A ticket cannot be modified after purchase. To change the date, time, or party size of a booking, you must cancel the existing purchase in accordance with the cancellation policy below and place a new purchase, subject to availability at the time of rebooking.

Group purchases. A guest purchasing more than one seat purchases on behalf of the full party and is the sole purchaser of record for that transaction. Remaining seats are assigned by sharing an invitation link following purchase. The purchaser of record is responsible for the full transaction, is the only party entitled to request cancellation or refund of that transaction, and is the only party with access to the receipt for that transaction.

Cancellation and refunds. You may cancel a ticket and receive a full refund to your original payment method provided the cancellation is made more than 48 hours before the scheduled event start time. Cancellations made 48 hours or less before the scheduled event start time are not eligible for refund. Refunds are processed through Stripe and may take several business days to appear depending on your financial institution.

Late arrival and no-show. Potioncast attractions run on a scheduled basis. Admission may not be possible after an experience has begun. Late arrival and failure to attend are not eligible for refund.

Cancellation or rescheduling by Potioncast. If Potioncast cancels an event, ticket holders will receive a full refund to the original payment method. If Potioncast reschedules an event, ticket holders may transfer to the new date or request a full refund.

Resale. Tickets are for personal use and may not be resold, offered for resale, or transferred for commercial gain. Potioncast may void without refund any ticket that it reasonably believes has been resold in violation of this provision.

Billing errors. If you believe a billing error has occurred, contact corporate@potioncast.com within 7 days of the transaction.

Third party sites and services

The Site may contain links to other websites ("Linked Sites"). Linked Sites are not under the control of Potioncast, and Potioncast is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site or any changes or updates to a Linked Site. Potioncast provides these links only as a convenience, and the inclusion of any link does not imply endorsement by Potioncast of the site or any association with its operators.

Certain services made available through the Site are delivered by third party providers, including Anthropic (AI processing), Supabase (data storage and authentication), Netlify (web hosting and application functions), Plausible (privacy-friendly website analytics), Stripe (payment processing), Resend (transactional email delivery), Airtable (event scheduling), and Beehiiv (newsletter delivery). By using any product, service, or functionality originating from the potioncast.com domain, you acknowledge and consent that Potioncast may share information and data with any third party with whom Potioncast has a contractual relationship in order to provide the requested product, service, or functionality.

Advertising and analytics

Potioncast uses privacy-friendly, cookieless analytics provided by Plausible to understand aggregate Site traffic. This analytics method does not place cookies on your device, does not use a persistent identifier for you, and does not track you across other websites.

Potioncast may advertise its attractions on third party platforms, including Meta Platforms (Facebook and Instagram) and TikTok. Potioncast does not currently place advertising tracking pixels or software development kits on the Site, and does not share information about your activity on the Site with advertising platforms.

If we begin using advertising or measurement technologies that place cookies or similar identifiers on your device, or that share information about your Site activity with advertising platforms, the Site will present a consent notice before those technologies are active, and you may accept or decline. Declining will not affect your ability to browse the Site, create an account, or purchase tickets.

We never sell your personal information.

We do not use archetype information, reading content, Memory records, or any information about who you attend with for advertising or targeting purposes, and we do not disclose that information to advertising platforms.

No unlawful or prohibited use; intellectual property

You are granted a non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these Terms. As a condition of your use of the Site, you warrant to Potioncast that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site.

All content included as part of the service, including text, graphics, logos, images, the compilation thereof, and any software used on the Site, is the property of Potioncast or its suppliers and is protected by copyright and other laws that protect intellectual property and proprietary rights. This includes the design, staging, scripting, effects, and creative content of Potioncast attractions. You agree to observe and abide by all copyright and other proprietary notices, legends, or restrictions contained in any such content and will not make any changes thereto.

You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the content, in whole or in part, found on the Site or presented at a Potioncast attraction. Your use of the Site does not entitle you to make any unauthorized use of any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Potioncast or our licensors except as expressly authorized by these Terms.

International users

The service is controlled, operated, and administered by Potioncast from our offices within the USA. If you access the service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use Potioncast content accessed through the Site in any country or in any manner prohibited by any applicable laws, restrictions, or regulations.

Indemnification

You agree to indemnify, defend, and hold harmless Potioncast, its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, your attendance at any Potioncast attraction, any user postings made by you, your violation of any terms of this Agreement, your violation of any rights of a third party, or your violation of any applicable laws, rules, or regulations. Potioncast reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Potioncast in asserting any available defenses.

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding, or arbitration arises out of or concerns these Terms, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees.

The parties agree to arbitrate all disputes and claims in regard to these Terms or any disputes arising as a result of these Terms, whether directly or indirectly, including tort claims that are a result of these Terms. This arbitration provision shall survive the termination of these Terms.

Class action waiver

Any arbitration under these Terms will take place on an individual basis; class arbitrations and class, representative, or collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/OR REPRESENTATIVE PROCEEDING. Further, unless both you and Potioncast agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

Liability disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. POTIONCAST CORPORATION AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.

POTIONCAST CORPORATION AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. POTIONCAST CORPORATION AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POTIONCAST CORPORATION AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, WITH ATTENDANCE AT OR PARTICIPATION IN ANY POTIONCAST ATTRACTION, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF POTIONCAST CORPORATION OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.

Nothing in these Terms excludes or limits liability for gross negligence, willful misconduct, or any other liability that may not be excluded or limited under applicable law.

Termination and access restriction

Potioncast reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Delaware, and you hereby consent to the exclusive jurisdiction and venue of courts in Delaware in all disputes arising out of or relating to the use of the Site.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Potioncast as a result of this agreement or use of the Site. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Potioncast with respect to the Site and the services, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the user and Potioncast with respect to the Site and the services.

Changes to terms

Potioncast reserves the right, in its sole discretion, to change the Terms under which the Site is offered. The most current version of the Terms supersedes all previous versions. Potioncast encourages you to periodically review the Terms to stay informed of updates.
